Terms of Service for Online Art Commissions:

These Terms of Service ("Agreement") govern the commissioning of artwork ("Commission") between the artist ("Artist") and the individual commissioning the artwork ("Commissioner"). By commissioning artwork from the Artist, the Commissioner agrees to the following terms:

Commission Process:

1.1. The Commissioner and Artist will agree on the scope, style, and details of the Commission, including any specific requirements or preferences.1.2. The Artist will provide a preliminary sketch for review and approval by the Commissioner. Once the Commissioner is satisfied with the sketch and provides the go signal, a down payment of 50% of the agreed-upon price will be required to proceed with the Commission.

Revisions:

2.1. Minor revisions to the sketch are included in the Commission price.2.2. If non-minor revisions are requested after the line art or color has been completed, an additional cost will be incurred based on the complexity and specificity of the requested revisions. The Artist will communicate the additional cost to the Commissioner before proceeding with the revisions.

Ownership and Usage Rights:

3.1. The Artist retains all rights to the commissioned artwork, including intellectual property rights, unless explicitly transferred in writing.3.2. The Artist has the right to post images of the commissioned artwork on their social media platforms and portfolio, crediting the Commissioner when applicable.

Refunds:

4.1. Once the down payment has been made and the Commission process has commenced, refunds are not applicable. The down payment is non-refundable.

Artistic Limitations:

5.1. The Artist reserves the right to refuse Commission requests for artwork that involves intricate and detailed subjects such as mechs, armor, and other complex elements.5.2. The Artist will not create artwork that depicts gore or violence with excessive and detailed depictions of internal organs or body parts.5.3. The Artist will not create any form of cub content.

Character Details:

6.1. The Commissioner is responsible for providing a reference sheet or detailed description of their character(s) for the Commission. Failure to provide a reference sheet may result in an additional fee based on the level of detail required for the Artist to create the character based on the description provided.

Communication:

7.1. The Commissioner agrees to maintain clear and prompt communication with the Artist throughout the Commission process.7.2. The Artist will make reasonable efforts to keep the Commissioner updated on the progress of the Commission.

Confidentiality:

8.1. The Artist agrees to keep all personal information provided by the Commissioner confidential and will not share it with third parties without the Commissioner's consent, unless required by law.

Payment:

9.1. Payment for the Commission will be made as follows: 50% down payment after approval of the sketch, and the remaining 50% upon completion of the Commission. The Artist will communicate the accepted payment methods to the Commissioner.

Delivery:

10.1. The Artist will provide the finished Commission in the agreed-upon format (e.g., digital file, physical print) within a reasonable timeframe, as discussed between the Artist and the Commissioner.

Dispute Resolution:

11.1. In the event of any disputes arising from the Commission, both parties agree to engage in good faith negotiations to resolve the dispute. If a resolution cannot be reached, either party may seek legal remedies available in their jurisdiction.

Amendments:

12.1. These Terms of Service may be amended or modified by mutual agreement in writing between the Artist and the Commissioner.By commissioning artwork from the Artist, the Commissioner acknowledges that they have read, understood, and agreed to all the terms and conditions outlined in this Agreement.
